Transaction and shareholder disputes
The issue: We were engaged by the Client who was sued for damages by a company to which our Client sold a portfolio of construction companies.
Outcome: We performed a review of the claims and identified that many of them were groundless or their amounts could have been easily challenged. Thanks to our work, the Client reduced its exposure resulting from the claims.
Case Study 9:
Complex commercial litigation
The issue: We were engaged by a technology company, which had been involved in litigation for many years, to support their lawyers with analysis of the financial condition of the plaintiff.
Outcome: As a result of our analysis it was identified that for a number of years there were various personal relationships associated with the plaintiff which meant that the poor financial position of the plaintiff had been hidden in inter-company transactions for many years. Arising from our work, the court ruled that the financial position of the plaintiff should be reviewed by a court appointed auditor.
Case Study 10:
Capital project disputes
The issue: We were requested by the Client to perform an independent review of the status of the construction project in Warsaw. The two main areas of concern were the escalating project costs and the actions required to recover the project programme. The request was a result of the claim from the main subcontractor received by our Client.
Outcome: We performed the review of the Project and we provided advice on possible negotiation tactics, which resulted in an agreement reached between the Client and the subcontractor.
Case Study 11:
Arbitration support
The issue: PwC was appointed by the Polish government involved in a dispute with a foreign investor. The investor claimed it had lost and will continue to lose profits as a result of an unfavourable decisions made by the Polish government.
Outcome: We were asked to prepare an expert witness report on this subject to be submitted in the arbitration court in Stockholm. As a result of our work the claimed amount was significantly reduced.
Case Study 12:
Expert witness services
The issue: PwC was engaged by an international corporation, whose local director was put on a criminal charge for acting to the detriment of Polish subsidiary.
Outcome: We were asked to perform a critique of the expert witness report, which constituted the basis for the charges. Our work revealed that the expert omitted key facts regarding the case and his conclusions were not supported by the quoted facts.
