Applying a new strategy as a key to success

Together with colleagues from other PwC teams and using a state-of-the-art tool such as the Review Center (offered by RelativityOne), we decided to take an innovative approach to the review, focusing on managing its effectiveness and continuously monitoring progress.

Challenge

Our client, a global automation and manufacturing company, had concerns about the potential involvement of its employees in a corruption scheme discovered by local law enforcement. Our objective was to determine the purpose and level of involvement. Additionally, we aimed to ascertain whether other employees within the client company were also participating, by examining documents (including emails) acquired from the client. During the course of the project, the Forensic team, in collaboration with experts from the PwC Centre of Excellence, uncovered evidence pointing to anti-competitive behavior, which resulted in the start of the second phase of the project and the need to continue reviewing documents on a much larger scale and under severe time pressure.

Solution

Active Learning increases efficiency and saves time

The cutting-edge tool we have utilized to create an innovative approach to the review is Continuous Active Learning (CAL). It is a document review support tool that helps us to quickly organize data and also predict which documents are most likely going to be relevant to the case. Therefore, by using CAL, we can reduce the overall review duration.

How exactly does it work?

While predictive coding starts with a set of source documents and refines its algorithm over time, CAL technology works continuously – it learns from the documents reviewed by analysts. Even with a small sample of tagged documents, CAL prompts the analyst to review the next relevant document. Consequently, we were able to accelerate the identification of potentially relevant documents. The technology has played a crucial role in expediting the review process, enabling us to swiftly discover key information. An additional advantage of Active Learning is that it can be used even during small projects, containing 1,000 documents or less.

High quality of work opens new opportunities

Use of CAL resulted in a fourfold increase of responsiveness rate. The use of CAL technology positively impacted the project team’s work, which quickly adapted to the innovative strategy and recognized its benefits. This new working model enabled the analysts to identify the most important and relevant documents more rapidly than with previous review methods. The strategy also facilitated the quick and efficient identification of the main areas of potential risk, thereby accelerating the entire review process. Identifying these areas during the early stages of the review allowed the project team to work more effectively and concentrate on the substantive details of the collected information.

Moreover, the work on the cited project is an excellent example of the harmonious collaboration that has developed between Forensic, eDiscovery, and Managed Services teams in Switzerland, the United States, the Netherlands, and Poland.
