Obligations arising from SENT

The bill has been approved by the Sejm, and its submission to the Senate and the President indicates that its adoption is almost certain. The President's signing of the bill is merely a formality, and its entry into force on November 1st is beyond doubt.

According to the latest information from the Department of Road Transport, the new obligations will apply to the following categories of foreign carriers:

From 1 November 2024 – carriers from third countries not based in an EU Member State, Switzerland, or an EFTA Member State.

From 1 January 2025 – carriers from other EU Member States, Switzerland, or EFTA Member States performing road transport to or from a third country based on a permit required by international agreements binding Poland and that country.

These carriers will be required to notify to the SENT register before crossing the Polish border and obtain a reference number for each transport. The notification will include, among other details, information about the origin and destination countries, the particulars of the foreign entity conducting the road transport, and the vehicle registration numbers.

Failure to comply with the new obligations may result in severe penalties and sanctions. Failure to register a given carriage in the monitoring system, may mean the detention of the vehicle by certain services and the imposition of financial penalties of around EUR 5,000 for each transport. What’s even more important, where lack of notification was identified during movement of goods, the transport will not be allowed to continue without amending the situation - causing further delays. 

Moreover, transports performed without notifying in the SENT system will be considered as transport without a transport permit, which may lead to unpleasant consequences.
