PRS market overview in Poland - summary of H2 2023

Institutional leasing is a constantly developing sector in the real estate industry. The number of available units and those under construction is constantly growing, and the apartments offered are becoming more and more popular among tenants. What are the upcoming trends and prospects for PRS in Poland? Which cities dominate in terms of housing offer? What are the key legal issues that an investor should keep in mind? In 2023, the total resources of the PRS sector amounted to nearly 17,000. units, which means an increase of % compared to 2022. Investors predict that an additional approximately apartments will be built by 2028. However, it is worth noting that this number may increase, taking into account new market participants who are just building their investment portfolios and the greater caution with which investors share their investment plans.

PRS investments - legal framework

Polish Law allows for the implementation of PRS investments even though there are no regulations explicitly referring to them. When implementing a PRS project, it is, therefore, necessary to ‘adopt’ provisions relating to other types of projects, such as e.g. residential, hotels, etc.  When considering the regulations applicable to a particular PRS project, a simple determination of the property's intended use (residential vs. commercial) is not sufficient.

Legal framework applicable to the PRS sector is presented in the PwC Report - “Review of the PRS market in Poland - first half of 2022” - published in October 2022. While no legislation directly 'dedicated' to PRS investments has been introduced since, legislative changes have been made, which, undoubtedly, will have an impact on the PRS sector.
